This describes what Atlas Marketing Group LLC does with information when you use MyGiftSong. It is written to be read, not to be survived. If anything here is unclear, ask us and we will explain it in plain words.
Atlas Marketing Group LLC, registered in State of Wyoming, USA, at 30 N Gould St, STE R, Sheridan, WY 82801, USA, decides how and why your information is used — the “controller”, in the language of European law. Questions, requests and complaints go to support@mygiftsong.com, which reaches a person rather than a queue.
Almost everything we hold, you typed. We do not buy data, and we do not build profiles from other sites.

We do not collect special categories of data on purpose, and we ask you not to put them in a brief. We do not knowingly process anyone's health, religion, sexuality or political views.
This deserves its own section, because it is unusual. A brief is normally about somebody else — their name, their habits, things that happened to them. We hold that information because you gave it to us in order to have the song made.
We use it for that and nothing else: never to contact the person the song is about, never to build a profile of them, never for marketing. If that person asks us to delete what we hold about them, we will, and you can ask on their behalf.
For the order itself, because we need the information to perform the contract you entered into. For payment records, because we are legally required to keep them. For following up on an unfinished order and for security and fraud work, on the basis of our legitimate interest — in recovering an unfinished order and in running a service that is not being abused — which we have weighed against your interests. You can object at any time by writing to us, and every such message carries a link that stops them on the spot.
Worth being exact about: your brief is sent to the providers in section 7 as soon as you submit it, before any payment. That is how the song can be ready so quickly, and it means the brief leaves us even if you never complete the order.
Only the companies that make the service work, and only what each one needs:

We name our payment processor because you deal with it directly at checkout. The others are described by what they do rather than by name, because the list changes as providers are added or replaced and a policy naming yesterday's would be wrong rather than transparent. Ask us and we will tell you exactly who holds your information today.
Beyond those: we will disclose information if the law requires it or to protect someone's safety, and if the business is ever sold or reorganised, records may transfer with it — in which case this policy continues to apply until the new owner tells you otherwise.
We do not sell personal information, and we do not share it for anyone else's advertising. We never have.
We are in the United States and our providers are mostly there too. If you are in the European Union or the United Kingdom, your information is transferred outside your country under the standard contractual clauses those providers operate, or an equivalent safeguard. You can ask us for details of the safeguard that applies to a particular provider.

You can ask us to delete any of it sooner and we will, apart from the payment records we are obliged to keep. If you do, the private page stops working — that is what deletion means here, and it cannot be undone.
The song is written by a machine, but no machine here makes a decision about you — not about whether to accept your order, what to charge you, or anything else with a legal or similarly significant effect. A person reviews the song before it is sent, and a person handles every refusal, revision and refund.
The site is served over HTTPS only. Card details never reach our server. Access to the admin panel is password-protected and limited to us, and song files are served through a gate rather than as public links. No system is perfect; if a breach ever affects your information we will tell you and the relevant regulator within the time the law allows, and we will say what happened rather than issue a statement about taking privacy seriously.
Four that make the site work, three that remember which advertisement brought you, and none set by anybody else:

Clearing them costs you nothing but the language preference. We honour Global Privacy Control and Do Not Track signals by default, in the sense that there is nothing to turn off: we do not track you across other sites in the first place.
We do not run a mailing list and we never sell or share your address. If you start an order and do not finish it, we may follow up about that order. Every such message carries a link that stops them for good, and replying to say so works just as well — there is no list to be removed from. Everything else we send is about an order you placed.
We can see whether our e-mails are opened and whether a link in one is followed, which is how we judge whether they are worth sending. It is not used to build a profile of you, and you can ask us to switch it off for your address.
Where we link elsewhere — a payment page, a social profile — that site's own policy governs what it does. We do not control them.
Wherever you live, you can ask us for a copy of what we hold about you, ask us to correct it, or ask us to delete it, and we will not treat you differently for asking.
European Union and United Kingdom. You also have the right to object to processing, to have it restricted, to receive your data in a portable form, and to complain to your data protection authority — in the UK, the Information Commissioner's Office. You do not have to come to us first, though we would rather you did.
California. You may request the categories and specific pieces of information collected, the purposes, and the categories of third parties it was disclosed to; request deletion; and request correction. We do not sell or share personal information as those terms are defined by the CCPA, and we have not in the last twelve months. If we ever refuse a request you may appeal by replying to our answer.

Brazil's General Data Protection Law gives you a set of rights we honour in full. You may ask us to confirm whether we hold anything about you and to show you what; to correct anything incomplete or out of date; to anonymise, block or delete anything we hold unnecessarily or hold in a way the law does not allow; to receive your data in a portable form; to be told who we have shared it with; and to be told what happens if you refuse consent.
Where we rely on your consent for something, you may withdraw it at any time and we will stop. Write to support@mygiftsong.com. If you are not satisfied with our answer you may complain to the Autoridade Nacional de Proteção de Dados.
Data protection law across the region gives broadly the same set of rights, and we apply them the same way wherever you write from.
Mexico. You have the ARCO rights — access, rectification, cancellation and objection — and may withdraw consent or limit how your data is used. The supervisory authority is INAI.
Colombia. You may know what we hold, have it corrected or deleted, withdraw the authorisation you gave, and be told how it has been used. The authority is the Superintendencia de Industria y Comercio.
Argentina. You may access what we hold free of charge at reasonable intervals and have it corrected, updated or deleted. The authority is the Agencia de Acceso a la Información Pública.
Chile. You may access, correct, delete and object to the use of what we hold.

The service is not for people under 16, and we do not knowingly collect their information. If you believe a child has sent us something, write to us and we will remove it.
If this policy changes in a way that matters, we will say so here and move the date at the top. Continuing to use the service after that means the new version applies.
